Terms and Conditions of the beSmart.bike Online Store

I. General Provisions

  1. The online store available at https://besmart.bike (“Store”) is operated by Artur Dmochowski, conducting business under the name Artur Dmochowski ARTNOVA, entered in the Central Register and Information on Economic Activity (CEIDG) maintained by the Minister of Economy of the Republic of Poland, with its registered office at ul. Mrówcza 85/4 unit 1, 04–857 Warsaw, Poland, NIP (Tax ID): 1180746769, REGON (Business ID): 015167524, phone: +48 502 520 533, e-mail: contact@besmart.bike.
  2. The Store sells bicycle mounts and related accessories through the Internet.
  3. These Terms and Conditions define the rules for using the Store, including placing orders, entering and fulfilling sales contracts, making payments, deliveries, handling complaints, exercising the right of withdrawal, and using a user account.
  4. The Store sells exclusively to individual consumers—natural persons making purchases not directly related to their business or professional activity.
  5. To use the Store, the customer must have a device with Internet access, a web browser, and an active e-mail address.

III. Orders and Sales Agreement

  1. Orders can be placed via the website https://besmart.bike.
  2. Purchases can be made:
    • by logging into a user account, or
    • as a guest, without registration.
  3. A sales contract is concluded at the moment the Store confirms acceptance of the order for processing, which the Customer is notified of via e-mail.
  4. All prices listed in the Store include VAT (gross prices).
  5. Delivery costs are not included in the product price and are displayed during the checkout process.
  6. The Seller reserves the right to change prices, provided that such changes do not affect orders already placed.

IV. Payments

  1. Payments are processed electronically via the TPay payment system.
  2. Payment is made at the time of placing the order.
  3. If payment is not received within 3 days of placing the order, the order may be canceled.

V. Delivery

  1. Ordered products are delivered by courier to the address provided by the Customer.
  2. Deliveries are made from the territory of the Republic of Poland to EU and non-EU countries.
  3. The Store does not offer personal pickup.
  4. Delivery costs and estimated delivery times are displayed during checkout.
  5. For deliveries outside the European Union, the Customer may be required to pay customs duties or local taxes in accordance with the laws of the destination country.

VI. Right of Withdrawal

  1. A Customer who is a consumer has the right to withdraw from a distance contract without giving any reason within 14 days of receiving the goods.
  2. To exercise this right, the Customer must send a declaration of withdrawal to the Seller—by post or by e-mail to contact@besmart.bike.
  3. A withdrawal form template is attached to these Terms and Conditions.
  4. The Customer must return the goods promptly, no later than 14 days from the date of submitting the withdrawal declaration, to the Seller’s registered address.
  5. The Customer bears the cost of returning the goods in the event of withdrawal.
  6. The Seller will refund all payments received from the Customer, including delivery costs, except for the cost of the cheapest available delivery method offered at the time of purchase.
  7. The refund will be made using the same payment method used by the Customer, unless the Customer agrees to another method that does not involve any costs for them.
  8. The Seller may withhold the refund until the goods are received back or proof of return is provided—whichever occurs first.

VII. Complaints – Statutory Warranty and Guarantee

  1. The Seller is liable to the Customer for defects in the goods under the statutory warranty (rękojmia) provided by the Polish Civil Code (Articles 556–576).
  2. The statutory warranty is valid for 2 years from the date of delivery.
  3. Complaints can be submitted:
  4. The complaint should include the Customer’s contact details, a description of the defect, and the Customer’s request (repair, replacement, price reduction, or withdrawal from the contract).
  5. The Seller will review the complaint within 14 days of receipt and inform the Customer of the outcome.
  6. Additionally, as the manufacturer, the Seller provides a 12-month quality guarantee covering manufacturing defects.
  7. The guarantee is fulfilled by replacing the product with a new one.
  8. Using the guarantee does not exclude, limit, or suspend the Customer’s rights under the statutory warranty.

VIII. Personal Data

  1. The data controller is Artur Dmochowski, conducting business under the name Artur Dmochowski ARTNOVA, based in Warsaw (04–857), ul. Mrówcza 85/4 unit 1, e-mail: contact@artnova.com.pl.
  2. Personal data is processed for the purpose of fulfilling orders, processing payments and deliveries, and complying with the Seller’s legal obligations.
  3. Detailed rules regarding personal data processing are defined in the Privacy Policy available on the Store’s website.

IX. Final Provisions

  1. Contracts concluded with the Store are governed by Polish law.
  2. Any disputes arising from the execution of the contract shall be resolved under Polish law, subject to the consumer protection laws of the Customer’s country of residence.
  3. The Customer may use out-of-court complaint and redress mechanisms, e.g. through the ODR platform: https://ec.europa.eu/consumers/odr.
  4. For matters not regulated herein, the relevant provisions of Polish law, in particular the Civil Code and the Consumer Rights Act, shall apply.
